{"id":3261,"date":"2025-01-01T19:21:00","date_gmt":"2025-01-01T18:21:00","guid":{"rendered":"https:\/\/isla-travel.de\/?page_id=3261"},"modified":"2025-05-22T17:36:23","modified_gmt":"2025-05-22T15:36:23","slug":"agb","status":"publish","type":"page","link":"https:\/\/isla-travel.de\/en\/agb\/","title":{"rendered":"General terms and conditions with customer information"},"content":{"rendered":"<p><strong>for travel organization and travel agency services<\/strong><br><strong>Status: January 2025<\/strong><\/p>\n\n\n\n<p>These terms and conditions govern the contractual relationship between you as a travel customer and&nbsp;<strong>ISLA PASSI\u00d3<\/strong>based in&nbsp;<strong>07659 Cala Figuera, Mallorca, Spain<\/strong>.<\/p>\n\n\n\n<p>ISLA PASSI\u00d3 offers both&nbsp;<strong>Own package tours as a tour operator<\/strong>&nbsp;as well as&nbsp;<strong>arranges individual tourist services<\/strong>&nbsp;third parties (e.g. vacation accommodation, rental cars or flights).<\/p>\n\n\n\n<p>Decisive for your rights and our obligations is,&nbsp;<strong>what role ISLA PASSI\u00d3 plays in your booking<\/strong>&nbsp;- This will be clearly stated in your booking confirmation.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>1. conclusion of contract<\/strong><\/h3>\n\n\n\n<p>With your booking (in writing, by telephone, by e-mail or via our website) you submit a binding offer to conclude a travel contract. The contract is concluded when you receive a written confirmation from us.<\/p>\n\n\n\n<p>You are liable for all contractual obligations of the participants you have registered. Please check the travel documents carefully and inform us immediately if you have not received them at least 14 days before departure.<\/p>\n\n\n\n<p><strong>Organizer service:<\/strong>&nbsp;In the case of package tours, we act as a tour operator within the meaning of the EU Package Travel Directive.<br><strong>Mediation service:<\/strong>&nbsp;For individual bookings such as hotel accommodation, flights and rental cars, we arrange third-party services. The contract is then concluded directly between you and the respective service provider.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>2. payment<\/strong><\/h3>\n\n\n\n<p>Upon receipt of the booking confirmation, a deposit of 30 % of the total price must be paid, the remaining amount 30 days before the start of the trip.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>For package tours<\/strong>\u00a0(organizer service), your payments are covered by Spanish insolvency insurance. You will receive details of this in your travel confirmation.<\/li>\n\n\n\n<li><strong>For placements<\/strong>\u00a0the terms of payment of the respective provider apply, which we will forward to you. We will claim payment on their behalf.<\/li>\n<\/ul>\n\n\n\n<p><strong>Payment options:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Bank transfer (free of charge)<\/li>\n\n\n\n<li>Credit card \/ PayPal (each +2 % fee)<\/li>\n<\/ul>\n\n\n\n<p>If the customer does not pay on time, ISLA PASSI\u00d3 may withdraw from the contract. Reminders will be subject to a reminder fee of up to \u20ac10 and interest on arrears.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>3. services \/ prices \/ changes<\/strong><\/h3>\n\n\n\n<p>The scope of the services booked is set out in the travel confirmation. We reserve the right to make changes prior to conclusion of the contract.<\/p>\n\n\n\n<p><strong>For tour operator trips<\/strong>Deviations after conclusion of the contract are only permitted if they are insignificant. In the event of significant changes, you are entitled to withdraw from the contract free of charge.<\/p>\n\n\n\n<p><strong>For placements<\/strong>: The respective conditions of the brokered provider apply.<\/p>\n\n\n\n<p>Check-in is from 16:00, check-out until 10:00 (unless otherwise agreed). We reserve the right to make additional charges in the event of non-compliance.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>4. overcrowding<\/strong><\/h3>\n\n\n\n<p>If the maximum permitted number of guests is exceeded without authorization, an additional payment of 80 % of the pro rata accommodation price per additional person may be required.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>5. withdrawal by the customer \/ rebooking<\/strong><\/h3>\n\n\n\n<p>You can withdraw at any time before the start of the trip. The declaration of withdrawal should be made in writing.<\/p>\n\n\n\n<p><strong>For package tours (organizer role):<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>up to 45 days before departure: 30 %<\/li>\n\n\n\n<li>up to 22 days: 40 %<\/li>\n\n\n\n<li>up to 15 days: 60 %<\/li>\n\n\n\n<li>up to 8 days: 70 %<\/li>\n\n\n\n<li>from 7 days \/ no-show: 80-100 %<\/li>\n<\/ul>\n\n\n\n<p><strong>In the case of agencies (e.g. accommodation):<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>up to 49 days before the start of the rental period: 30 %<\/li>\n\n\n\n<li>48-35 days: 50 %<\/li>\n\n\n\n<li>34-22 days: 60 %<\/li>\n\n\n\n<li>21-14 days: 90 %<\/li>\n\n\n\n<li>from 13 days \/ no-show: 100 %<\/li>\n<\/ul>\n\n\n\n<p>Processing fees may be charged for changes to bookings. Subsequent changes are deemed to be a withdrawal and new booking.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>6. services not utilized<\/strong><\/h3>\n\n\n\n<p>If individual services are not used, no refund will be made - unless the provider reimburses us the corresponding amount.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>7. travel cancellation insurance<\/strong><\/h3>\n\n\n\n<p>We strongly recommend that you take out travel cancellation insurance. On request, we can arrange an appropriate policy through our insurance partner.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>8. withdrawal by the organizer<\/strong><\/h3>\n\n\n\n<p><strong>ISLA PASSI\u00d3 can withdraw from the contract as organizer<\/strong>if:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the customer is in default of payment,<\/li>\n\n\n\n<li>the minimum number of participants is not reached,<\/li>\n\n\n\n<li>there are economic reasons,<\/li>\n\n\n\n<li>force majeure prevents implementation.<\/li>\n<\/ul>\n\n\n\n<p>Payments already made will be refunded. There are no further claims.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>9. force majeure<\/strong><\/h3>\n\n\n\n<p>If unforeseeable events (e.g. natural disasters, pandemics) jeopardize the trip, both parties may terminate the contract. Return travel costs are to be borne equally.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>10 Liability &amp; Warranty<\/strong><\/h3>\n\n\n\n<p><strong>As organizer<\/strong>&nbsp;we are liable for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>proper execution of the trip,<\/li>\n\n\n\n<li>Selection of service providers,<\/li>\n\n\n\n<li>Correctness of the service description.<\/li>\n<\/ul>\n\n\n\n<p><strong>Limitation of liability:<\/strong><br>For damages that are not physical injuries, we are liable up to a maximum of three times the travel price - except in cases of intent or gross negligence.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>11. arranged services (e.g. flights, rental cars)<\/strong><\/h3>\n\n\n\n<p>In the case of third-party services, we are&nbsp;<strong>exclusively as an intermediary<\/strong>&nbsp;active. The general terms and conditions of the respective provider apply. We are not liable for the proper execution.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>12. duty to cooperate<\/strong><\/h3>\n\n\n\n<p>Travelers are obliged to cooperate in the event of service disruptions and to report defects immediately. The statutory limitation period is 1 year (beginning with the contractual end of the trip).<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>14. passport, visa and health regulations<\/strong><\/h3>\n\n\n\n<p>Please inform yourself about the applicable entry and health regulations. The customer is liable for any omissions that result in refusal of entry.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>15. mobility restrictions<\/strong><\/h3>\n\n\n\n<p>Our tours are only accessible to a limited extent. Please contact us before booking to check individual suitability.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>16. reservation of price changes<\/strong><\/h3>\n\n\n\n<p>We reserve the right to adjust prices in the event of significant changes in costs (e.g. exchange rates, taxes, transportation costs) in accordance with EU travel law.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>17 Place of jurisdiction \/ Applicable law<\/strong><\/h3>\n\n\n\n<p>It applies&nbsp;<strong>Spanish law<\/strong>. Place of jurisdiction is - as far as legally permissible -&nbsp;<strong>Palma de Mallorca<\/strong>. Nicht in Anspruch genommene Leistungen<\/h3>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>Bei vorzeitiger Abreise oder Nichtinanspruchnahme einzelner Leistungen besteht kein Anspruch auf R\u00fcckerstattung, es sei denn, der Leistungstr\u00e4ger erstattet uns nachweislich entsprechende Betr\u00e4ge.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading {\"level\":3} -->\n<h3 class=\"wp-block-heading\">7.
